Privacy Policy

BackupMaster Technologies Pty Ltd. (ABN 34 695 017 648), a company incorporated in Australia (“BackupMaster”), has adopted this Privacy Policy to inform you of its policies regarding information collected from the backupmaster.io website and through the BackupMaster cloud-based Service. This document covers how BackupMaster collects, uses, discloses, and protects your Personal Data; the types of Personal Data we may collect directly from you or indirectly through cookies or third parties; and our practices for collecting, using, maintaining, protecting, and disclosing that data.

Please read the following information carefully before providing your Personal Data to BackupMaster. This Privacy Policy explains how BackupMaster collects, uses, discloses, and protects Personal Data. Where BackupMaster relies on consent for a specific processing activity, BackupMaster will request that consent separately where required by applicable law.

For BackupMaster’s obligations regarding the processing of Personal Data in accordance with Regulation (EU) 2016/679 (General Data Protection Regulation (“GDPR”)), please see the BackupMaster Data Processing Addendum.

When BackupMaster processes Personal Data on behalf of a Customer through the Service (for example, Personal Data contained in the data a Customer backs up), BackupMaster generally acts as a processor or service provider, and the Customer is responsible for providing appropriate notices and obtaining any required rights or consents. That processing is governed by the BackupMaster Data Processing Addendum. This Privacy Policy primarily describes how BackupMaster processes Personal Data when it acts as a controller, including for website visitors, account users, support contacts, prospective customers, billing and administrative contacts, and marketing communications.

By visiting our site and using the BackupMaster cloud-based Service, you acknowledge that BackupMaster may transfer, process, and store your Personal Data in countries other than your own. Where Personal Data is transferred outside the EEA, the United Kingdom, or Switzerland to a country without an adequacy decision, BackupMaster relies on appropriate safeguards, such as the Standard Contractual Clauses approved by the European Commission, or another lawful transfer mechanism.

1. Personal Data

Personal Data means information relating to an identified or identifiable individual. BackupMaster may collect Personal Data directly from you, automatically when you use the website or Service, from Customers who invite or authorize you to use the Service, from Cloud Service Providers, from payment providers, or from other third parties where permitted by law. BackupMaster will process the following Personal Data you provide to BackupMaster while visiting the backupmaster.io website, contacting BackupMaster customer support service, setting up your BackupMaster Service user account, or using BackupMaster cloud-based Service via the BackupMaster app user interface:

BackupMaster may collect usage, log, device, and analytics information when you visit the website or use the Service, including pages viewed, features used, actions taken, access times, IP address, browser and device information, and referring URLs, and uses this information to provide, secure, support, monitor, and improve the website and Service. You may also be asked additional marketing-related questions by completing questionnaires, surveys, and profile data to help BackupMaster better understand your needs and those of potential customers. As for the backupmaster.io website, you can visit and browse it without revealing Personal Data. You may also choose to disclose Personal Data, which may be maintained as described below.

2. Purpose and legal basis of processing Personal Data

This Privacy Policy sets out the essential details relating to your Personal Data relationships with BackupMaster as a website visitor, end-user of the BackupMaster cloud-based Service, prospective client, job applicant, or contractor. BackupMaster may use Personal Data collected through its website and BackupMaster cloud-based Service primarily for the purposes of providing Service and support to users, improving the website and Service, including tailoring it to users’ preferences, providing users with product or Service updates, promotional notices, and offers, and other information about BackupMaster, responding to your questions, inquiries, comments, and instructions, maintaining the security and integrity of its systems.

2.1. Processing for the purpose of contract performance and fulfillment of legal obligations

Customers contract using BackupMaster Service and give access to their employees and other third parties, as solely decided by them, by creating users who access BackupMaster Service with their email addresses and credentials. BackupMaster provides customers with its Service in accordance with the terms and conditions of the BackupMaster Terms of Service here. Please note that under the contract, you may receive emails with technical and operational notices regarding the BackupMaster Service functionality. These notices are part of BackupMaster’s communication with you as a party to the contract. The purpose and legal basis of the processing of your Personal Data, in this case, therefore, involves the performance of the BackupMaster Service contract. Such emails do not constitute “direct marketing,” and you may not opt-out of them. The legal basis for processing, in this case, is Art. 6(1)(b) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of Personal Data and on the free movement of such data, and repealing Directive 95/46/EC (“General Data Protection Regulation”). BackupMaster also needs to process this kind of Personal Data to fulfill its other legal duties. Under several laws (e.g., tax and accounting laws), BackupMaster has to process Personal Data stipulated above. The legal basis, in this case, is Art. 6(1)(c) of the General Data Protection Regulation.

2.2. Processing of Personal Data from requests to BackupMaster customer support service

When you contact BackupMaster customer support service, BackupMaster may use the Personal Data you provide to communicate with you, respond to your inquiry, provide support, and, where applicable, take steps before entering into or performing a contract. The legal basis for this processing, where GDPR applies, may be the performance of a contract or steps taken before entering into a contract under Art. 6(1)(b) of the GDPR, or BackupMaster’s legitimate interests under Art. 6(1)(f) of the GDPR in responding to inquiries, providing support, and maintaining effective customer communications. BackupMaster may also collect information when you open email messages from BackupMaster customer support service or click on links within those email messages.

2.3. Website and in-app usage information

BackupMaster may collect usage, log, device, and analytics information when you visit the backupmaster.io website or use the BackupMaster cloud-based Service. This may include pages viewed, features used, actions taken, access times, IP address, browser and device information, and product usage information. BackupMaster uses this information to provide, secure, support, monitor, maintain, and improve the website and Service, including helping users with support requests and understanding product adoption and usage. The legal basis for this processing, where GDPR applies, is BackupMaster’s legitimate interests under Art. 6(1)(f) of the GDPR and, where the processing is necessary to provide the Service requested by you, performance of a contract under Art. 6(1)(b) of the GDPR.

2.4. Usage, device, and browsing information

BackupMaster uses the usage and device information collected automatically by its servers primarily to help it administer and improve its website. BackupMaster collects this information when you visit the backupmaster.io website and use the BackupMaster cloud-based Service through cookies and similar technologies. This information includes:

BackupMaster uses cookies and similar technologies to operate the website, remember preferences, understand website usage, improve the website and Service, and, where applicable, measure the effectiveness of communications. Some cookies are necessary for the website or Service to function. For example, BackupMaster uses Google Analytics to understand how visitors use the website. Where required by law, BackupMaster will request consent before using non-essential cookies or similar technologies. Most web browsers let you manage or disable cookies; if you disable cookies, some features of the website may not function properly.

2.6. Choice and opt-out

In order to provide Service to you, BackupMaster will send you communications related to your transactions, security, or the administration of its website. From time to time, BackupMaster may also wish to send you other messages or updates about BackupMaster, or its promotions and other activities. If you do not wish to receive non-transaction/security-related communications from BackupMaster, please send an email containing your request to customer service support@backupmaster.io. Even if you opt-out of receiving marketing communications, BackupMaster may still communicate with you in connection with security and privacy issues, servicing your account, fulfilling your requests, or administering any promotion or any program in which you may have elected to participate.

Where permitted by law, BackupMaster may use business contact information to send product updates, security updates, and marketing communications about BackupMaster services. You may opt out of marketing communications at any time by using the unsubscribe link in the email, where available, or by contacting support@backupmaster.io. BackupMaster will continue to send transactional, security, legal, billing, and service-related communications where necessary.

3. Personal Data protection

BackupMaster is committed to protecting the security of all Personal Data collected and used. BackupMaster maintains industry-standard technical, physical, electronic, and procedural safeguards to help guard Personal Data. Personal Data stored in the BackupMaster Service is encrypted at rest, and Personal Data transmitted to and from the Service is encrypted in transit using industry-standard transport encryption. BackupMaster restricts authorized access to your Personal Data to those persons who have a legitimate purpose of knowing that information to provide products or services to you and those persons you have authorized to have access to such information. Please be aware, however, that any email or other transmission you send through the internet cannot be completely protected against unauthorized interception. BackupMaster’s Service and data are hosted on Microsoft Azure data centres in the United States. BackupMaster regularly performs security and risk assessments on Microsoft’s security and privacy controls and reviews Microsoft’s security and compliance documentation to ensure Microsoft Azure security controls are in line with industry-standard best practices. 4. Sub-processors

BackupMaster uses third parties to help provide BackupMaster services and manage business operations. These sub-processors may have access to Personal Data collected through backupmaster.io or through the BackupMaster cloud-based Service, as reasonably necessary to perform services on BackupMaster’s behalf. BackupMaster enters into appropriate contractual arrangements with its sub-processors and assesses their security and privacy practices, where appropriate, to help ensure that Personal Data is used only to provide services to BackupMaster and is not sold or disclosed except as permitted by BackupMaster or applicable law. Where required for international transfers, BackupMaster relies on appropriate transfer safeguards, such as Standard Contractual Clauses or another lawful transfer mechanism. 5. Personal data disclosure

BackupMaster does not provide Personal Data to unaffiliated third parties for their use in marketing directly to you. BackupMaster may use unaffiliated companies to help it maintain and operate its website or for other reasons related to the operation of its business, and those companies may receive your Personal Data for that purpose. BackupMaster does not sell your information to any third party. Finally, as the BackupMaster business develops, it may sell or buy corporate assets, and in such transactions, the customer’s Personal Data may be one of the transferred business assets. If BackupMaster, its internet businesses, or substantially all of its assets are acquired, the customer’s Personal Data may be one of the assets transferred.

6. Legal disclosures

BackupMaster may need to disclose Personal Data to comply with legal and regulatory requirements and legal processes, including responding to lawful requests from public and governmental authorities and court orders. BackupMaster attempts to notify our clients about legal demands for their Personal Data when appropriate in our judgment, unless prohibited by law or court order, or when the request is an emergency.

7. Data storage period

BackupMaster retains Personal Data for as long as reasonably necessary for the purposes described in this Privacy Policy, including to provide the Service, maintain business records, comply with legal obligations, resolve disputes, enforce agreements, maintain security, prevent fraud, and support legitimate business operations. Retention periods vary depending on the type of data and the purpose for which it is processed.

When you use the BackupMaster cloud-based Service, BackupMaster processes your Personal Data for a period of time prescribed by the applicable subscription plan you subscribe to, and thereafter such personal data shall be irretrievably deleted within 30 business days in accordance with BackupMaster’s standard deletion policies as set out in the BackupMaster Data Processing Addendum, subject to any legal obligations to further retain such Personal Data. BackupMaster may retain Personal Data to comply with the law, prevent fraud, collect fees, resolve disputes, troubleshoot problems, assist with investigations, enforce BackupMaster Terms of Service and take other actions permitted by law. The Personal Data BackupMaster retains will be handled in accordance with this Privacy Policy. BackupMaster will also process your Personal Data for direct marketing purposes. However, if you opt-out of offerings of BackupMaster Service by sending an email to customer service at support@backupmaster.io, BackupMaster will cease to process the relevant Personal Data for these purposes even during the remaining term of the contract. Personal Data connected to you that is no longer necessary and relevant to provide BackupMaster Service may be de-identified or aggregated with other non-personal data to provide insights that are commercially valuable to BackupMaster, such as statistics of the use of Service.

8. Children’s privacy

The backupmaster.io website and the BackupMaster cloud-based Service are not intended for persons under the age of 13 if they reside in the United States, or 16 if they reside anywhere else. BackupMaster will not approve applications of, or establish or maintain accounts or memberships for, any child whom BackupMaster knows to be under the age of 13 if they reside in the US, or 16 if they reside anywhere else. BackupMaster.io does not solicit or knowingly collect personally identifiable information from children under the age of 13 if they reside in the US, or 16 if they reside anywhere else. If BackupMaster nevertheless discovers that it has received personally identifiable information from an individual who indicates that they are, or whom BackupMaster otherwise has reason to believe is, under the age of 13 if they reside in the US, or 16 if they reside anywhere else, BackupMaster will delete such information from its systems. A child’s parent or legal guardian may also request that the child’s information be corrected or deleted from BackupMaster’s files by emailing customer service at support@backupmaster.io.

The backupmaster.io website may contain links to third-party websites or services. BackupMaster is not responsible for the privacy practices, security, or content of those third-party websites or services. BackupMaster encourages you to review the privacy policies of any third-party websites or services before providing Personal Data to them.

10. Your Personal Data protection rights

BackupMaster would like to make sure you are fully aware of all of your Personal Data protection rights. Every user of BackupMaster’s Service and every visitor of the backupmaster.io website is entitled to the following:

The right to access. You have the right to request BackupMaster for copies of your Personal Data.

The right to rectification. You have the right to request that BackupMaster correct any information you believe is inaccurate. You also have the right to request BackupMaster to complete the information you believe is incomplete.

The right to erasure. You have the right to request that BackupMaster erase your Personal Data, under certain conditions (please see BackupMaster Data Processing Addendum).

The right to restrict processing. You have the right to request that BackupMaster restrict the processing of your Personal Data, under certain conditions (regarding the use of BackupMaster Service, please see BackupMaster Terms of Service).

The right to object to processing. You have the right to object to BackupMaster’s processing of your Personal Data, under certain conditions (regarding the use of BackupMaster Service, please see BackupMaster Terms of Service).

The right to data portability. You have the right to request that BackupMaster transfer your Personal Data that we have collected to another organization or directly to you.

The right to withdraw consent. Where BackupMaster processes your Personal Data based on your consent, you have the right to withdraw that consent at any time, without affecting the lawfulness of processing carried out before the withdrawal.

The right to lodge a complaint. You have the right to lodge a complaint with a data protection supervisory authority regarding BackupMaster’s processing of your Personal Data.

If you would like to exercise any of these rights, please send an email containing your request to customer service at support@backupmaster.io. BackupMaster does not charge a fee to exercise these rights, except that, to the extent permitted by applicable law, BackupMaster may charge a reasonable fee or decline to act where a request is manifestly unfounded, repetitive, or excessive.
